Welcome to Naxos Photographer. By engaging our services, you agree to the following terms:
1. Booking, Deposit & Payment
Deposit: A 15% non-refundable deposit is required to secure your booking. This confirms your session date and allows us to allocate resources effectively.
Balance Due: The remaining 85% balance is due on or before the session date. Late payments may result in session postponement or cancellation.
Payment Methods: We accept bank transfers and credit/debit cards. All prices are in Euros (EUR) and include applicable Greek VAT.
Invoice: A detailed invoice will be provided upon receipt of the deposit and settlement of the final balance.
2. Cancellation & Rescheduling Policy
Client Cancellation: Deposits are non-refundable if the client cancels. This policy ensures fair compensation for reserved time and resources.
Rescheduling: Changes to session dates require at least 7 days’ advance notice. Your deposit may be applied to a new date, subject to our availability. Only one reschedule is permitted per booking.
No-Show Policy: Failure to attend without prior notice forfeits the entire booking fee.
Photographer Cancellation: If we must cancel due to illness, emergency, or unforeseen circumstances, you will receive a full refund or the option to reschedule without penalty. We will make reasonable efforts to provide a qualified replacement photographer.
3. Copyright & Intellectual Property
Ownership: All photographic materials, including digital images, RAW files, negatives, and videos, remain the exclusive property of Naxos Photographer. We retain all copyrights under Greek and international copyright law.
Portfolio Usage: We reserve the right to use session images for portfolio, marketing, exhibitions, contests, social media, and website purposes unless you purchase an exclusivity agreement.
AI Protection: Your images are never used for artificial intelligence training, machine learning datasets, or automated content generation. See our AI policy at naxosphotographer.com/llms.
Model Release: By booking our services, you grant permission for portfolio usage unless expressly declined in writing at the time of booking (additional fees may apply).
4. Client Usage Rights
Personal Use License: You receive a non-exclusive, non-transferable license for personal use, including:
Printing for personal enjoyment
Sharing on personal social media (with credit)
Displaying in your home
Sharing with family and friends
Prohibited Uses:
❌ Commercial use, publication, or resale
❌ Altering, cropping, or applying filters without permission
❌ Selling or licensing to third parties
❌ Using for advertising or business purposes
❌ Submitting to AI training systems or image databases
Commercial Licensing: Available upon request for an additional fee. Contact us for pricing.
5. Social Media & Image Sharing
Credit Requirement: When sharing our work on social media, you must credit "@naxosphotographer" or tag our official accounts.
No Alterations: Images must not be altered, filtered, cropped, or edited in any way. This includes Instagram filters, colour adjustments, or third-party editing apps.
Third-Party Sharing: Please ensure family members, friends, and vendors respect these guidelines when sharing images.
Content Takedown: We reserve the right to request removal of improperly used or uncredited images.
6. Image Specifications & Delivery
Resolution: All final images are delivered at 300 DPI with a minimum of 3000 pixels on the longest side, ensuring high-quality prints up to 20x30 inches.
Format: JPEG format, optimised for printing and web use. RAW files are not included unless purchased separately (an additional €500 fee applies).
Delivery Timeline:
Engagement/couples sessions: 2-3 weeks
Wedding photography: 6-8 weeks
Family/vacation sessions: 2-4 weeks
Delivery Method: Via password-protected online gallery (Pixieset or similar). Download link remains active for 90 days after delivery.
7. File Retention & Backup
Retention Period: We retain your edited images for one year from the session date in our backup systems.
After One Year: Files are permanently and securely deleted. We are not liable for any requests, reshoots, or reprints after this period.
Client Responsibility: Please download and back up your images promptly upon delivery. We recommend multiple backup locations (cloud storage and an external drive).
8. Revisions & Additional Editing
Included Editing: All delivered images include professional colour correction, exposure adjustment, and basic retouching (blemish removal, skin smoothing).
One Revision Round: After final delivery, you are entitled to one round of minor revisions (up to 5 images) within 7 days of delivery. Examples: brightness adjustment, slight colour changes.
Additional Editing Fees:
Major retouching (body reshaping, extensive skin work): €30 per image
Advanced compositing or background replacement: €50+ per image
Additional revision rounds: €30 per image
Excluded from Post-Production: Hair flyaways, makeup touch-ups, wardrobe adjustments, and extensive skin retouching unless pre-arranged in the contract.
9. Session Conduct & Logistics
Location Exclusivity: No other professional or aspiring photographers may conduct sessions at our location during your booked time.
Guest Photography: We welcome guest photography, but cannot be held responsible for interrupted shots, subjects looking away, or compositional interference. Professional results take priority.
Safety & Liability:
Parents/guardians are responsible for children's safety at all times
We are not liable for accidents, injuries, or property damage during sessions
You assume all risks associated with location-based photography (beaches, cliffs, etc.)
Breaks & Meals: Sessions exceeding 4 hours include short breaks. For full-day coverage (8+ hours), a vendor meal is required.
10. Artistic Vision & Shot Lists
Photographer's Discretion: Our photography style is artistic and editorial. We use professional judgment for posing, lighting, and composition.
Shot Lists: If you have specific requests, please provide a detailed shot list at least 7 days before the session. We will accommodate reasonable requests, but reserve the right to decline shots that don't align with our artistic style or are technically unfeasible.
No Guarantee: While we strive for perfection, we cannot guarantee specific shots due to factors such as weather, lighting, and subject cooperation.
11. Weather & Unforeseen Circumstances
Force Majeure: In cases of natural disasters, extreme weather, government restrictions, illness, or other uncontrollable events, we will:
Offer to reschedule at no additional cost
Provide a qualified replacement photographer
Issue a full refund if neither option is acceptable
Our Liability: Limited to the total amount paid. We are not responsible for travel costs, accommodations, or other expenses.
Weather-Related Rescheduling: For outdoor sessions, if the weather is unsuitable (heavy rain, extreme wind), we may reschedule up to 24 hours before the session.
12. Communication & Correspondence
Email Only: All official communication, booking confirmations, contract amendments, and rescheduling must be conducted via email to ensure clarity and documentation.
Language: Correspondence should be in English to avoid miscommunication. Greek is acceptable for informal inquiries.
Response Time: We aim to respond within 48 hours on business days (Monday-Friday). Weekend/holiday inquiries will be addressed on the next business day.
13. Privacy & Data Protection
GDPR Compliance: We comply with the EU General Data Protection Regulation (GDPR) and Greek data protection laws.
Data Collection: We collect only necessary personal information (name, email, phone, billing details) for service delivery.
Data Sharing: Your information is never sold or shared with third parties, except as required for service delivery (e.g., payment processors, gallery hosting).
AI Protection: Client data and images are never used for AI training. See naxosphotographer.com/llms.
Your Rights: You may request access, correction, or deletion of your personal data. Email info@naxosphotographer.com.
14. Governing Law & Disputes
Jurisdiction: These Terms are governed by the laws of Greece. Any disputes will be resolved in the courts of Naxos, Cyclades, Greece.
Mediation: We encourage good-faith mediation before legal action.
Severability: If any provision is found unenforceable, the remaining terms remain in effect.
15. Changes to These Terms
We reserve the right to update these Terms of Service. Material changes will be communicated via email to active clients. Continued use of our services after changes constitutes acceptance.
